1. Acceptance of Terms

Welcome to Imagineairy, an AI-powered image generation service provided by IMAGINEAIRY PHOTOGRAPHICS PVT LTD ("we," "us," or "our"). By accessing or using our website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. Description of Service

Imagineairy allows users to generate images based on text prompts using MiniMax's Image generation model, accessed through Replicate's API. The Service includes features such as user authentication, image generation, and a public showcase gallery. Images are stored on third-party storage services (Cloudflare R2 or Google Cloud Storage), and metadata is stored in our MongoDB database.

3. User Accounts and Authentication

To access certain features, you must create an account via Clerk, our authentication provider. You agree to provide accurate information and keep your account credentials secure. You are responsible for all activities under your account.

4. Image Generation and Ownership

Images generated through the Service are created using MiniMax's Image Generation AI model via Replicate's API. You retain ownership of the prompts you submit and the generated images, subject to MiniMax's Terms of Service (https://intl.minimaxi.com/protocol/terms-of-service) and Replicate's terms, which you agree to comply with. We do not claim ownership of generated images, but you grant us a non-exclusive, worldwide, royalty-free license to display, store, and share your images in the public showcase gallery if you choose to share them.

You may not use the Service to generate images that are illegal, harmful, offensive, or violate third-party rights (e.g., copyright, privacy). We and MiniMax reserve the right to review and remove any content that violates these Terms or MiniMax's policies.

5. User Conduct

You agree not to:

• Use the Service for unlawful purposes or to generate content that is offensive, harmful, or violates applicable laws.
• Attempt to reverse-engineer, misuse, or interfere with the Replicate or MiniMax APIs or our infrastructure.
• Share or generate content that infringes on intellectual property, privacy, or other third-party rights.
• Use generated images in ways that violate MiniMax's Terms of Service or local laws.

6. Third-Party Services

The Service relies on third-party providers, including Replicate (for API access), MiniMax (for image generation), Clerk (for authentication), and Cloudflare R2 or Google Cloud Storage (for storage). Prompts and generated images are sent to MiniMax via Replicate for processing. These providers have their own terms and policies, including MiniMax's Terms of Service (https://intl.minimaxi.com/protocol/terms-of-service) and Privacy Policy (https://intl.minimaxi.com/protocol/privacy-policy), which you agree to follow when using the Service. We are not responsible for the practices of these third-party providers.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including issues with generated images, third-party services, or interruptions in service. Our total liability shall not exceed the amount you paid (if any) to use the Service, except where prohibited by law.

8. Termination

We may suspend or terminate your access to the juger Service at our discretion, including for violations of these Terms or MiniMax's policies. MiniMax may also restrict access to their model for non-compliance. You may terminate your account at any time by contacting us.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service constitutes acceptance of the updated Terms.
